Decision making

Decision-making in mediation is a collaborative process in which the parties to a dispute work together, under the guidance of the mediator, to reach mutually agreeable solutions. The aim is to empower the parties to make informed and voluntary decisions that address their underlying interests and concerns.

Probing questions

The “Probing Questions” strategy involves the mediator asking detailed, thoughtful questions after the parties reach an agreement to ensure that all aspects of the agreement are thoroughly discussed. By posing “what if” scenarios and exploring potential challenges in the implementation, the mediator helps the parties address possible contingencies and ensure that the agreement is both sustainable and feasible in practice.
