ADR Assessment & Analysis

In partnership with the European Bank for Reconstruction and Development, IDLO – with the support of ADR Center’s experts – is implementing a project that aims to promote and facilitate the use of arbitration and commercial mediation on a national scale, with the goal of mainstreaming alternative dispute resolution methods for business in the country. Under the project, IDLO and ADR Center’s experts will assess the use and implementation of commercial mediation in Moldova, including existing legislation. Through training and mediation simulation, the Consortium works to strengthen the institutional capacity of the Ministry of Justice and other relevant institutions, including civil society organizations, and will develop a communications strategy to strengthen advocacy around alternative dispute resolution.
The principal objective is twofold: 1) to assist the Government of Moldova with promoting and facilitating the use of commercial mediation on a national scale, 2) to assist the Government of Moldova and existing institutions in the field of arbitration with improving access to arbitration and raising the level of skills relevant for arbitration, with the overall goal of making the use of ADR a business norm in Moldova.
Specifically, in such context IDLO subcontracted ADR Center’s CEO – Leonardo D’Urso – and ADR Center’s International Expert – Constantin-Adi Gavrila – to implement the ADR project activities.
As part of this Project, IDLO requested D’Urso and Gavrila to draft an ADR Action Plan as the production of directions for interventions and related actions and activities, structured to further develop the use of alternative dispute resolution in Moldova. The action plan is to detail the actions and activities necessary for the achievement of the Strategic Direction nr. 3 Efficient and Modern Justice, Objective 3.2 Consolidation of the Alternative Dispute Resolution and is intended to be part of the more extensive action plan for the entire strategy.
Drawing on the results of the assessments and analysis of Commercial Mediation in Moldova, a Working Group, comprised of representatives of the Mediation Council, the Mediation Center of the Chamber of Commerce and Industry, national and international experts was formed to assist the Ministry of Justice to draft the action plan for the advancement and use of commercial mediation in Moldova.
