CONSULTANCY TO ADVICE THE KENYA BANKERS ASSOCIATION ON THE IMPLEMENTATION OF AN EFFECTIVE ALTERNATIVE DISPUTE RESOLUTION MECHANISM

The Kenya Bankers Association (KBA) awarded ADR Center a consultancy contract to advise the KBA on the implementation of an effective alternative dispute resolution mechanism. The Terms of Reference identified that this mechanism would be a Banking Industry Mediation Center set up by the KBA with support from various stakeholders and that the Center would function independent of the banks in order to provide neutral mediation services.

SELECT ACTIVITIES

  • A comprehensive stakeholder engagement plan was carried out during in-country missions to Nairobi.
  • A review of international banking ADR models was carried out resulting in a comprehensive framework proposal suitable for the Kenyan market. The review studied banking ADR models from Italy, France, South Africa, Australia, Malaysia, Turkey, Morocco and Serbia. The study identified best practices and potential models for the KBA mechanism.
